Continued to Successfully Prosecute Employer Vaccine Mandate Religious Discrimination and Accomodation Cases The NCLP continued to effectively advocate for many faithful employees who suffered religious discrimination, including wrongful termination by employers who refused to follow well-established federal and state employment laws and reasonably accommodate their sincerely held religious objections to the vaccine mandate during the pandemic. This years NCLP religious accommodation legal success include Lindsey v. NBCUniversal, Webb v. FM Global Insurance, Tuczynska v. Sharp and Angus v. Sharp. In December 2023, the NCLP began preparing a new lawsuit on behalf of a Christian nurse who worked at Kaiser Permanente before they unlawfully terminated her after discriminating against her faith at work by refusing to reasonably accomodate her religious convictions abou the COVID-19 vaccines. We continued to litigate Giannella v. Sharp, a case that would result in a favorable settlement in 2024. The NCLP has a 100 success rate in employment vaccine mandate religious accommodation cases
Victory Obtained for Religious Liberty in Church of Compassion v. Johnson The NCLP filed a federal civil rights lawsuit and a motion for preliminary injuction against the California Department of Social Services CDSS and the U.S. Department of Agriculture USDA after California unconstitutionally suspended USDA food program funds from a Christian churchs preschol serving poor immigrant children in El Cajon, California. The sole reason was because the church would not cpitulate to government pressure to sign a new sexual orientation and gender identity on-discrimination document. Before the preliminary injuction could even be heard, the government completely capitulated and surrendered, agreeing to reimburse the church for suspended USDA funds and pay attorneys fees. Going forward, the CDSS and USDA have agreed to provide exemtions for religious institutions, which the NCLP argued are constitutionally required.
NCLP Scores Victories for Parental Rights CA Public School Districts Beginning in June of 2023, the NCLP issued a series of impactful legal memos to public school board members in support of model parental notification policies PNP. We argued parents have a constituional right to be notified if their child is experiencing gender dysphoria at school. The NCLP also worked on creating model PNPs. In spite of threats from government officials, ten bold and courageous school districts adopted PNPs. In September, 2023, in Mirabelli v. Olson, Judge Benitez agreed with our legal analysis that the Fourteenth Amendment and U.S. Supreme Court precedent require that parent must be notified if their child is struggling with gender disphoria at school and, additionally, that Christina public-school teachers have the First Amendment right to notify parents. The legislature reactively passed AB 1955 attmpting to stymie the growing parental rights movement. The fight for parental rights and religious freedom continues.
